Terms of Service

1. Agreement

These terms are between you and KeySkape Solutions LLC ("we", "us"). By creating an account or using ki-skape, you agree to them. If you are using ki-skape for an organisation, you confirm you are authorised to accept these terms for it.

2. Your account

• You must be at least 18 years old to use ki-skape. This is not a preference on our part: the providers of the AI models behind the product set 18 as their minimum, so we cannot make the service available below it.
• You are responsible for keeping your account credentials secure and for activity that occurs under your account.
• You must provide an accurate email address and keep it current.

3. Ownership of content

You own your content. You retain all rights to the files you upload and, as between you and us, to the outputs generated for you. We claim no ownership over them.

You grant us only the limited licence necessary to operate the service — to store your files, to transmit your input to the AI model provider you have chosen, and to display your work back to you in your library. We do not use your content to train our own models.

You are responsible for ensuring you have the rights to any content you upload, and that your use of generated outputs complies with applicable law and with the terms of the underlying model provider.

4. Credits and billing

• Usage is metered in credits. 1 credit = $0.001 USD.
• Monthly credits are included with a paid plan and refill each billing cycle. Up to 25% of an unused monthly balance carries into the following cycle; the remainder expires.
• Top-up credits are purchased separately and do not expire.
• Credits are spent from your monthly balance first, then from your top-up balance.
• Credits have no cash value, are not transferable, and are not redeemable for money.
• Some operations are charged upfront and reconciled afterwards. If an operation fails, or you cancel it before it completes, the credits are refunded to the balance they were taken from.

5. Plans, renewal, and cancellation

• Paid plans renew automatically at the end of each billing period until cancelled.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• If a subscription lapses or is cancelled, your account reverts to the free plan. Monthly credits stop refilling; purchased top-up credits remain.
• Prices may change. We will give notice before a change affects a renewal.

6. Acceptable use

You agree not to use ki-skape to:

• Break any applicable law, or infringe anyone's intellectual property, privacy, or other rights.
• Generate child sexual abuse material, or content that sexualises minors, in any form.
• Create content intended to harass, defame, threaten, or incite violence against people.
• Impersonate a real person or organisation, including by cloning a voice you have no right to use, or to produce deceptive material presented as genuine.
• Attempt to bypass metering, quotas, plan limits, or authentication, or to gain access to another user's data.
• Disrupt, overload, or reverse-engineer the service or the infrastructure it runs on.
• Resell or redistribute access to the service without our written agreement.

Voice cloning may only be used with a voice that is your own, or one you have documented permission to use. We may suspend or terminate accounts that breach this section.

7. Third-party AI models

ki-skape gives you access to AI models operated by third-party providers. When you use a generative feature, your input is transmitted to the relevant provider, which may operate outside the European Union. Your use of those models is additionally subject to that provider's own terms and acceptable-use policies. We do not control, and are not responsible for, the output a model produces. See our Privacy Policy for how this affects your data.

Generated output may be inaccurate, offensive, or unsuitable for your purpose. Review it before you rely on it or publish it.

8. Storage limits and service availability

• Each plan includes a storage allowance, a maximum file size, and a maximum media duration. We may refuse or remove uploads that exceed them.
• We may remove content associated with accounts that have been closed or that breach these terms.
• We aim for high availability but do not guarantee uninterrupted service.

9. Testing phase

ki-skape is currently in a testing phase. Features may change, be added, or be withdrawn, and occasional interruptions should be expected. Where a change materially reduces functionality you have paid for, contact us and we will put it right.

10. Suspension and termination

You may stop using ki-skape and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, if required by law, or to protect the service or its users. Where circumstances allow, we will give notice first.

11. Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law.

To the extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, or for loss of profits or data.

Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

12. Changes to these terms

We may update these terms. If a change is material, we will update the date at the top of this page and notify you by email. Continuing to use ki-skape after a change takes effect means you accept the updated terms.
